Funcionamiento delusivo subclínico en contextos judiciales: marco conceptual y propuesta metodológica para la evaluación psicológica forense

La diferenciación entre delirio clínico, idea sobrevalorada y configuraciones inferenciales rígidas en contextos judiciales constituye un desafío metodológico central en la evaluación psicológica forense. Aunque el DSM-5-TR y la CIE-11 establecen criterios diagnósticos para los trastornos delirantes, persiste una zona intermedia insuficientemente conceptualizada entre la cognición normativa y la psicosis estructurada. El presente trabajo propone el constructo de Funcionamiento Delusivo Subclínico Contextual (FDSC) como un marco analítico destinado a describir configuraciones inferenciales rígidas en contextos jurídicos sin ampliar la nosografía psiquiátrica.
Este modelo integra aportes de la psicopatología dimensional, de los modelos cognitivos del delirio, de la teoría del procesamiento dual, de la metacognición y los enfoques contemporáneos sobre actualización de creencias. Se define como una configuración inferencial dependiente del contexto, caracterizada por una convicción elevada, la integración retrospectiva selectiva de ambigüedades, la actualización asimétrica de la evidencia, la resistencia significativa —aunque no absoluta— a hipótesis alternativas y la preservación global del juicio de realidad y del funcionamiento general. Además, se propone un marco metodológico para su operacionalización en la práctica pericial mediante una entrevista clínico-forense estructurada, procedimientos explícitos de contraste de hipótesis e integración cualitativa con psicometría estandarizada. El objetivo es fortalecer la transparencia inferencial del informe pericial y ofrecer una herramienta analítica replicable para el análisis de contextos judiciales complejos.
